<p>So, when asked about all of this, by the FBI Special Agent, a little less than one year later &#8212; Dick Cheney could not at first recall whether he and Scooter Libby <em><strong>had ever discussed</strong></em> Joe Wilson&#8217;s trip as &#8220;<em><strong>a junket</strong></em>&#8220;. All sources put Scooter Libby <em>with</em> Dick Cheney, in Jackson Hole on that July 4 weekend. What are the odds that &#8212; if Dick Cheney took the time to make a note &#8212; in his own hand, thus: &#8220;<em>Did his wife [Valerie Plame] send him [Wilson] on a <strong>junket</strong>?</em>&#8220;, on the plane back to DC, that day, that he didn&#8217;t <strong><em>already know </em></strong>Plame was CIA, and that Joe Wilson had &#8220;<strong><em>outed</em></strong>&#8221; one of the central lies embedded in the 16 words? [Later, perhaps recalling his handwritten notes, Cheney allows that it is "possible" he and Scooter discussed the trip, as a junket or boondoggle.]</p>
<p>It seems <em>unfathomable</em>, that such a sharp political mind as Mr. Cheney is reputed to possess, would have made an <em>entirely trivial note </em>on Air Force Two, then done <em>nothing</em> about it &#8212; and in fact, <em>forgotten it entirely</em>, for almost a year. But, in order to decide that Mr. Cheney was not at least <em>winking and nodding </em>in the director of Scooter Libby, about Valerie Plame and Joe Wilson &#8212; we must assume just that unlikely set of occurences. That he wrote the note for <em>no reason</em>, watched the ensuing debacle unfold &#8212; about the falsity of the 16 words. . .  and <em>never</em> pursued any method to blunt the impact of these highly-damaging revelations. Go figure.</p>
<p>Moreover, what are the odds that he would not have tasked Scooter Libby with throwing up a <em>fog of disinformation</em>, to cover the Veep&#8217;s (and, potentially, the President&#8217;s) tracks &#8212; about the clear-falsity of the 16 words in the President&#8217;s State of the Union address &#8212; words used to begin the war in Iraq?</p>
<p>Slim to none. Slim &#8212; to none. Let&#8217;s talk to Eric Holder about a special prosecutor, again. Related: Do go read the <strong><em>Atlantic Wire </em></strong>blog piece &#8212; <a href="http://www.theatlanticwire.com/opinions/view/opinion/What-Did-Dick-Cheney-Know-and-When-Did-He-Know-it-1459">on these developments</a>.</p>
<p>UPDATED: Read <A href="http://emptywheel.firedoglake.com/2009/11/01/cheneys-betrayal-made-an-iipa-charge-for-libby-possible/"><strong><em>Marcy Wheeler&#8217;s latest</em></strong></a>, thus:</p>
<blockquote><p><font color="#040080"><i>. . .Cheney was <strong>publicly</strong> implying that he would have had the authority to declassify Plame’s identity. Perhaps this was just an attempt to make people ignore inquiries like mine. But it’s just as likely that <strong>when Cheney realized that Libby had testified he had ordered Libby to leak stuff to Judy Miller (this happened the same weekend Cheney shot an old man in the face!)</strong>, he wanted to give Libby the impression that his own testimony protected Libby from an IIPA violation.</p>
<p>But it didn’t. Judy’s unreliable testimony saved Libby. But without that, <strong>Cheney’s own testimony would have been the evidence Fitzgerald would have needed to charge Libby with deliberately outing a CIA spy</strong>. . .</i></font></p></blockquote>

<p>Note that these &#8220;<em>lack of recollections</em>&#8221; are at variance with every other piece of evidence gathered, and then presented to the jury &#8212; in Scooter Libby&#8217;s perjury and obstruction of justice trial.</p>
<p><strong><em>It is time to indict this man</em></strong>. There is little doubt that the above passage reflects a very carefully-couched set of lies &#8212; about when and how Dick Cheney first learned of Valerie Plame&#8217;s role at CIA; and thus covers his likely hand in having her outed &#8212; in retribution for Joe Wilson&#8217;s work <em>debunking</em> Niger yellowcake to Iraq stories as <em>fabrications</em>. Of course, those <em>fabricated stories </em>were a large part of the justification offered, by this Vice President, and Bush43, for our military engagment in Iraq.</p>

If you have an al-Qaida guy wandering around certain bits of the world we might decide that we need to deal with that ourselves, directly, without making a lot of noise,&#8221; he said. &#8220;There was a plan to deal with that. It was much talked about in the CIA and the military had its own operation.&#8221;</p>
<p>Another former senior intelligence official responsible for dealing with al-Qaida said that assassination plans were reined in after similar covert operations by the military were botched and proved to be embarrassing, <strong>particularly the killing in Kenya. He did not give details of the operation</strong>. . .</p>
<p>There appears to be <strong>common agreement</strong> among knowledgeable former intelligence officials that <strong>the controversy goes beyond the immediate question of assassination </strong>and capture of al-Qaida operatives. . .</i></font></p></blockquote>
<p>Quick &#8212; who did we kill, and <em>badly</em>, in Kenya? Any guesses? A two second Google search turns up <A href="http://www.nytimes.com/2008/02/01/world/africa/01kenya.html?_r=1&amp;pagewanted=1&amp;ref=world">this coverage, in <em>The New York Times</em></a>:</p>
<blockquote><p><font color="DARKGREEN"><i>. . .Neither of the opposition lawmakers killed this week [February 1, 2008] was especially prominent. Both were just weeks into their new jobs as national politicians. Opposition leaders, however, say that is not the point. The opposition holds a slight edge in Parliament, and its leaders contend that the government is trying to reduce their numbers, an accusation it denies. </p>
<p>On Tuesday, Melitus Mugabe Were, a lawmaker and businessman who grew up in a slum, was shot to death in his driveway by two gunmen. The police are closely investigating the killing, but <strong>Mr. Were’s friends and family say he was not robbed and that the killing was a professional hit</strong>. . .</I></font></p></blockquote>
<p>As ever, there will be more, on <em>this</em> &#8212; and <em>that</em>, as it is <A href="http://indictdickcheney.blogspot.com/2009/07/shanes-latest-it-sounds-great-in-movies.html">now reported</a>, by Scott Shane, that then-CIA Director Hayden ordered the secret program scaled back, after he first learned of it, in the Spring of 2008. </p>
<p><strong>That would be only several weeks after this &#8220;<em>professioanl hit</em>&#8221; &#8212; in Kenya.</strong></p>
<p>By the way, neither of the dead Kenyan legislators had <em>any</em> known ties to Al Qaeda. In addition, President Gerald Ford in 1976 issued an executive order banning assassinations. </p>
<p>But the ban does not apply to the killing of enemies in a war. . . [And, apparently, Bush took that position.]</p>
<p>Hina Shamsi, an adviser to the Project on Extrajudicial Execution at New York University, said such a calculation about inserting a kill team would include the violation of the sovereignty of the country where the killing occurred; the different legal status of the C.I.A. by comparison with the uniformed military; and whether the killing would be covered by the law of war. </p>

<p>. . .In 2001, the CIA also examined the subject of targeted assassinations of al Qaeda leaders, according to three former intelligence officials. It appears that those discussions tapered off within six months. It isn’t clear whether they were an early part of the CIA initiative that Mr. Panetta stopped. . .<br />

<p>So, the Republican defense tactic here, will be to “<em>dress it up</em>” — as a program to carry out a presidential directive.</p>
<p>One would think that CIA Director Panetta would have asked whether the program was pursuant to a presidential order, or finding, before briefing Congress, in late June.</p>
<p>So — I suspect — the actual “<em>Blackbriar/Treadstone</em>” project Cheney kept under wraps for eight years, will turn out to be something else. Something <em>broader</em>, or more <em>specific</em> — but <strong><em>not</em></strong> something that Bush had ordered be <em>carried out</em>, with <em>specificity</em>.</p>
<p>That’s my guess.</p>

<blockquote><p><font color="#040080"><i>. . .The Central Intelligence Agency <strong>withheld information</strong> about a secret counterterrorism program from Congress <strong>for eight years on direct orders from former Vice President Dick Cheney</strong>, the agency’s director, Leon E. Panetta, has told the Senate and House intelligence committees, two people with direct knowledge of the matter said Saturday. . .</p>
<p><img ALIGN="RIGHT" src="http://4.bp.blogspot.com/_M_OtwEgZgAk/Rhbz9LCjWUI/AAAAAAAAAII/8Lz0YFL7B5k/s200/cheney1.jpg" border="0"> The <strong>law requires </strong>the president to make sure the intelligence committees “<strong>are kept fully and currently informed of the intelligence activities of the United States, including any significant anticipated intelligence activity</strong>.” But the language of the statute, the amended National Security Act of 1947, leaves some leeway for judgment, saying such briefings should be done “to the extent consistent with due regard for the protection from unauthorized disclosure of classified information relating to sensitive intelligence sources and methods or other exceptionally sensitive matters.”</p>
<p>In addition, for covert action programs, a particularly secret category in which the role of the United States is hidden, the law says that briefings can be limited to the so-called Gang of Eight, consisting of the Republican and Democratic leaders of both houses of Congress and of their intelligence committees. </p>
<p>The disclosure about Mr. Cheney’s role in the unidentified C.I.A. program comes a day after an inspector general’s report underscored the central role of the former vice president’s office in restricting to a small circle of officials knowledge of the National Security Agency’s program of eavesdropping without warrants, a degree of secrecy that the report concluded hurt the effectiveness of the counterterrorism surveillance effort. . .</p>
<p>A report released on Friday . . . makes clear that Mr. Cheney’s legal adviser, <strong>David S. Addington, had to personally approve every government official who was told about the program</strong>. The report said “the exceptionally compartmented nature of the program” frustrated F.B.I. agents who were assigned to follow up on tips it turned up.</p>
<p>High-level N.S.A. officials who were responsible for ensuring that the surveillance program was legal, including the agency’s inspector general and general counsel, were not permitted by Mr. Cheney’s office to read the Justice Department opinion that found the eavesdropping legal, several officials said. . .</i></font></p></blockquote>
<p>I am truly hopeful, again, that Eric Holder will take aim directly at Dick Cheney&#8217;s lawlessness.</p>

<p>The <A href="http://www.latimes.com/news/nationworld/nation/la-na-cia-cheney12-2009jul12,0,2470959.story"><i>Los Angeles Times</i></a> is running CIA quotes calling agency proponents would-be &#8220;<em>Jason Bourne</em>&#8221; types:</p>
<blockquote><p><font color="#040080"><i>. . .Some former high-level CIA officials said they remained puzzled about which program could be at the center of the budding controversy.</p>
<p>&#8220;A lot of people <strong>thought they were Jason Bourne and came up with ideas</strong>,&#8221; said a former senior CIA officer, referring to the fictional super-spy. &#8220;There were programs that were kind of wild that were considered in 2001. . .&#8221;</i></font></p></blockquote>
<p>It would all be rather droll, if we hadn&#8217;t <em>tortured</em> people over stuff like this; and lied our way into a <em>quagmire</em> in Iraq over it, as well.</p>

<p>earlier, the court had granted howards<br />
the right to take former vice-president<br />
cheney&#8217;s deposition &#8212; today&#8217;s order allows<br />
howards&#8217; lawyers ample time to get that scheduled<br />
and completed, well before a now-extended (to a<br />
final september 11, 2009 conference) and a<br />
september 9, 2009 trial date.</p>
<p>today&#8217;s orders <em>also</em> prevented the dismissal<br />
of several of the officer-defendants (on the grounds<br />
of imunity). that is a very strong hint that this<br />
one is going to turn on the particular facts dick<br />
cheney either <em>admits</em> to, or has <em>cross-examined </em>out<br />
of him &#8212; at the coming civil deposition. were i<br />
a betting man, and i am, i&#8217;d bet real money that<br />
dick cheney will be <em>counseled</em> to settle &#8212; before<br />
the new trial date comes. i bet he&#8217;ll sit for his depo,<br />
but i think he&#8217;ll get sufficiently &#8220;<em>tangled up</em>&#8221; there,<br />
that he&#8217;ll have few real option beyond agreeing to<br />
pay mr. howards &#8212; or end up being humiliated in a<br />
very public five-day trial in the federal courthouse<br />
in denver, colorado. and that is the way it should<br />
probably go, afterall. take a look:</p>

<p>this is all about whether we, ordinary citizens of<br />
these united states, do still possess the fundamental<br />
right to dissent from our government&#8217;s policies,<br />
and petition it &#8212; for the &#8220;<em>redress of [our] grievances</em>. . .&#8221;</p>

<p>Furthermore, and <strong>perhaps more obviously, Mr. Cheney is no longer a high-ranking government official</strong>, so the Court questions whether these cases are still applicable. In any event, the Court believes that Mr. Cheney should be deposed because <strong>he has relevant testimony that is unavailable from any other source in this case</strong>. . .</i></font></p></blockquote>
<p>no doubt, cheney&#8217;s lawyers will appeal<br />
this order allowing the service, and<br />
therefore, the sworn deposition of the dick.</p>
<p>so &#8212; it will be a while, but he will<br />
eventually have to answer &#8212; under oath &#8212; why<br />
he ordered his guards to arrest steven howard<br />
for simply expressing his first amendment pro-<br />
tected views about the administration&#8217;s policies<br />
in iraq. one small one for the good guys.</p>

<p>cheney had argued that he need only preserve<br />
records he deemed central to duties <em>directly<br />
assigned him by the president</em> in an official<br />
capacity, or generated in an official capacity<br />
in his (largely ceremonial) legislative role &#8212; in<br />
other words, <em>almost no records</em>, at all. . .</p>
<p>the able judge believes there is substantial<br />
doubt about whether cheney&#8217;s view is correct &#8212; given<br />
that the PRA was specifiaclly amended to deal<br />
expressly with shenanigans attempted by dick<br />
cheney&#8217;s old boss at a former white house &#8212; one<br />
richard m. nixon &#8212; (when dick was a welp), and to<br />
definatively put an end to attempts made, on<br />
nixon&#8217;s behalf, to shield many of the records<br />
of that <em>ignoble</em> presidency, from public view. </p>
<p>quoth <A href="http://www.citizensforethics.org/files/Memorandum%20Opinion_1.pdf">judge kollar-kotellly</a>:</p>
<blockquote><p><font color="#040080"><I>. . .the Court is guided by the Supreme Court’s discussion of the purposes underlying the PRA’s enactment in Nixon v. Administrator of General Services, as explained above. The PRA serves to “preserve [Presidential and Vice-Presidential] materials for legitimate historical and governmental purposes” and to ensure that future members of the executive branch can access historical records as necessary in carrying out their duties. 433 U.S. at 452-53. The PRA also serves the public interest by ensuring the “preservation of an accurate and complete historical record” by “trusted and disinterested professionals,” and thus enhances “the public confidence in our political processes.” Id. at 452-53 and n.14 (quoting Nixon v. Administrator of General Servs., 408 F. Supp. 321, 338-39 (D.D.C. 1976)).</p>

Defendants admit that they have only preserved under the PRA those records that they have unilaterally determined to be encompassed in the phrase “documentary material . . . created or received by the [Vice] President . . . in the course of conducting activities which relate to or have an effect upon the carrying out of [his] constitutional, statutory, or other official or ceremonial duties . . . .” 44 U.S.C. § 2201(2). <strong>The American public, however, has a right to the preservation of all records encompassed by the PRA’s statutory language.</strong> As such, until the Court is able to determine whether Defendants’ narrowed interpretation is legally supported, the public interest favors the issuance of a preliminary injunction. . .</p>
<p>For the foregoing reasons, the Court shall GRANT Plaintiffs’ [3] Motion for Preliminary Injunction. As set forth in the Order accompanying this Memorandum Opinion, the Court shall order all Defendants to preserve throughout the pendency of this litigation all documentary material, or any reasonably segregable portion thereof created or received by the Vice President, his staff, or a unit or individual of the Office of the Vice President whose function is to advise and assist the Vice President, in the course of conducting activities which relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the Vice President, <strong>without regard to any limiting definitions that Defendants may believe are appropriate</strong>. . .</I></font></p></blockquote>

<p><i>PLAINTIFF, Steven Howards, by and through counsel David A. Lane and Althea S. Licht of Killmer, Lane &amp; Newman, LLP, respectfully submits his Reply to the Office of the Vice President’s Opposition to Plaintiff’s Renewed Motion for United States Marshals to Serve Subpoena, as follows:</p>
<p>I. <strong>INTRODUCTION</strong></p>
<p>Pursuant to this Court’s order, Plaintiff Steven Howards has re-filed a motion to depose Vice President Dick Cheney regarding the interaction between Plaintiff and the Vice President giving rise to Plaintiff’s arrest for assault. Since Plaintiff’s original motion was filed, Mr. Howards has complied with the Court’s order to depose additional Secret Service agents. Despite having deposed three additional agents, the deposition of the Vice President remains necessary to this litigation.</p>
<p><a href="http://bp1.blogger.com/_M_OtwEgZgAk/R93L5IwSBAI/AAAAAAAAA_k/9lrnhuNxKhA/s1600-h/cheney-touch.jpg"><img style="float:right;cursor:hand;margin:0 0 10px 10px;" src="http://bp1.blogger.com/_M_OtwEgZgAk/R93L5IwSBAI/AAAAAAAAA_k/9lrnhuNxKhA/s320/cheney-touch.jpg" border="0" /></a> Plaintiff Steven Howards has set forth three claims for relief: (1) a violation of his Fourth Amendment right to be free from unreasonable seizures, (2) a violation of his Fourth Amendment right to be free from unreasonable searches, and (3) violations of his First Amendment rights of free speech and to petition his government. See, First Am. Compl. The Vice President’s testimony, as the victim of the “crime,” is necessary to the determination of these claims. However, the necessity of the deposition is not premised solely upon the fact that the eye witnesses (of whom there is only a limited number) have provided conflicting stories about the incident, as the OVP would have the Court believe. As Plaintiff has previously established, exceptional circumstances exist in this case by virtue of the fact that some of these witnesses, officers of the United States, are allegedly lying under oath.</p>
<p>II. <strong>ARGUMENT</strong></p>
<p>A. <strong>The Deposition of the Vice President Remains Necessary to Plaintiff’s Fourth Amendment claims</strong>.</p>
<p>Mr. Howards’ Fourth Amendment claims hinge upon whether the arresting agents had probable cause to make the arrest, and the Vice President is in the single best position to aid the Court in making this determination. Notably, <strong>only two of the eight agents deposed testified that they had probable cause to arrest Mr. Howards</strong>, one of whom -– the actual arresting agent –- did not even witness the encounter with the Vice President. See, Exh. A, Reichle Depo. 9:2-5; Exh. B, Doyle Depo. 68:4-10. The primary arresting officer, Defendant Gus Reichle, despite not observing Mr. Howards approach the Vice President, decided to arrest Mr. Howards because of “his premeditation, Mr. Howards would not talk to me, the fact he’s walking around with a bag in his hand in an unmagged area, and the fact that you’re telling me that he had unsolicited contact, I had probable cause, so I decided to make an arrest and I went after Mr. Howards.” Exh. A, Reichle Depo. 34:15-35:1. Remarkably, the other agents testified that probable cause did not exist to arrest Mr. Howards. See, Exh. C, Daniels Depo. 47:3-10 (“I personally did not have probable cause”); 48:4-5 (“[p]robable cause did not exist to make an arrest”); Exh. D, McLaughlin Depo. 69:12-18; 87:3-6 (affirming that probable cause did not exist to arrest Mr. Howards); Exh. E, Lee Depo., 20:3-4 (stating that he did not believe that an assault had taken place); Exh. F, Wurst Depo. 11:15-18; 18:13-19:2; 22:19-23:6 (stating that he did not see a crime – neither assault nor any other crime – committed in his presence). The two other agents that have been deposed did not see the interaction between Mr. Howards and the Vice President at all. Exh. G, Mischloney Depo. 8:1-5; 14:21-22; Exh. H, Rosales Depo. 8:11-16.</p>
<p>Indeed, the probable cause determination does not rest upon whether the Vice President personally felt he was slapped. <strong>However, this case does not simply involve the differing testimonies of eye witnesses, as can be expected in any litigation. This is the exceptional case in which some of the Secret Service agents alleged that other agents were lying under oath.</strong> Defendant Reichle testified that Defendant McLaughlin changed his testimony regarding what he saw between Mr. Howards and the Vice President. Exh. A, Reichle Depo. 47:22-48:13. Defendant McLaughlin then testified that he was told by Defendant Reichle to change his story about what he had observed. Exh. D, McLaughlin Depo. 134:13-135:17. Thus, with the victim of the crime having yet to testify, the parties are left with the testimony of five agents, at least one of whom has been accused of changing his story. <strong>Whether other agents also altered their stories remains uncertain</strong>.</p>
<p>Certainly, a more reliable record must be developed in order for Mr. Howards’ Fourth Amendment claims to be properly adjudicated. Beck v. Ohio, 379 U.S. 89, 93 (1964) (finding that the <strong>poorly developed record precluded the Court from finding that the arrest was made within the confines of the Fourth Amendment</strong>).</p>
<p>B. <strong>The Deposition of the Vice President is Necessary to Plaintiff’s First Amendment Claim</strong></p>
<p>Plaintiff’s Third Claim for relief involves Defendants’ acts “of intimidating, threatening, searching, and falsely arresting Mr. Howards” because of Mr. Howards’ exercise of constitutionally protected conduct. First Am. Compl. ¶¶ 31-36. In the April 15, 2008 Order, this Court briefly addressed Plaintiff’s First Amendment claim in the context of deposing the Vice President. Relying solely on Defendant Reichle’s testimony &#8212; that he did not discuss the incident with the Vice President &#8212; the Court stated that “it is difficult to see how a deposition of the Vice President would be relevant to Plaintiff’s third claim for relief.” Order, p.17 However, Defendant Reichle, was not in the vicinity of Mr. Howards when he approached the Vice President and did not hear what was said. In fact, seven of the eight Secret Service agents who have been deposed did not hear what Mr. Howards said to the Vice President. Exh. I, Daniels Statement, p. 2 (stating that Mr. Howards’ statements were inaudible from where he was standing); Exh. J, McLaughlin Statement, p. 2 (stating that, from across the street, he could not hear what Mr. Howards said); Exh. B, Doyle Depo. 49:9-50:6 (“I saw Mr. Howards make a statement. I don&#8217;t know what statement he made to the Vice President.”); Exh. F, Wurst Depo., 10:14-18 (stating only that Mr. Howards said “something” to the Vice President); Exh. G, Mischloney Depo. 19:22- 20:7 (stating that he solely relied on what other agents had told him, not what he had seen or heard himself); Exh. H, Rosales Depo. 8:11-16 (confirming that he did not hear (or observe) the interaction).</p>
<p>The only witnesses who testified to hearing Mr. Howards’ statement were Agent Lee, OVP aide Charles Durkin, and White House photographer David Bohrer. See, Exh. E, Lee Depo. 16:21-17:4 (stating that Mr. Howards said something along the lines of “You guys messed up Iraq”); Exh. K, Durkin Depo.18:14-19:4 (stating only that Mr. Howards made a statement “regarding Iraq policy”); Ex. L, Bohrer Depo., 10:6-15 (testifying that he heard “someone yelling about the Vice President’s Iraq policy”).</p>
<p>Whether Mr. Howards was arrested in violation of his First Amendment rights depends on the precise words that he spoke to the Vice President, and only the Vice President himself can verify what was said. Given the severity of Mr. Howards’ treatment and the significance of the potential constitutional violation at stake, a determination of what exactly transpired is critical to this case.</p>
<p>C. <strong>It is Within This Court’s Discretion to Allow the Deposition to Proceed</strong></p>
<p>It is within the trial court’s discretion to allow a deposition of a high-ranking official to proceed so long as the party seeking the deposition has shown that the official has first-hand knowledge of the claims being litigated and the information cannot be obtained from any other source. Bogan v. City of Boston, 489 F.3d 417, 423-424 (1st Cir. 2007); Fed.R.Civ.P. 26(b)(1) (“For good cause the court may order discovery of any matter relevant to the subject matter involved in the action”). To be sure, the limitations in deposing a senior government official are not absolute. Id. at 423. <strong>Indeed, the Vice President, no less than the President himself, is “scarcely immune from judicial process</strong>.” Halperin v. Kissinger, 606 F.2d 1192, 1211 (D.C.Cir.1979); Clinton v. Jones, 520 U.S. 681, 703 (“it is also settled that the President is subject to judicial process in appropriate circumstances”).</p>
<p>The Vice President’s position alone, therefore, will not insulate him from litigation, particularly when the constitutional rights of a citizen are denied at his expense.</p>
<p>Moreover, the trial court has the discretion to manage the deposition so as not to overly interfere with the official’s busy schedule. See, Jones, 520 U.S. at 702 (“if properly managed by the District Court, it appears to us highly unlikely to occupy any substantial amount of petitioner’s time”). Thus, the Court may properly address the OVP’s concerns regarding the Vice President’s time constraints by limiting the deposition to a time period shorter than that allowed by Federal Rule of Civil Procedure 30 (d)(2). The OVP’s argument that the “preparation and the to-and-fro involved with any deposition” will take more than an hour’s time is wholly unavailing. In light of the fact that the Vice President will be asked questions related to an incident that lasted mere seconds, it is hard to imagine that any lengthy “preparation” time is required of him. Moreover, undersigned counsel has stated that he will travel to a location convenient for the Vice President in order to avoid the “to-and-fro” of a deposition that the OVP protests.</p>
<p>Additionally, although the OVP poses an argument grounded in the separation of powers doctrine, “[t]he litigation of questions that relate entirely to the unofficial conduct of the individual who happens to be the President [or, in this case, the Vice President] poses no perceptible risk of misallocation of either judicial power or executive power.” Jones, 520 U.S. at 701. While certainly this Court must adhere to the moving party’s burden in order to require the Vice President’s deposition, constitutional principles do not “require” the court to protect the Vice President from a deposition if warranted. </p>
<p>Here, there is no protective order in place preventing the deposition to go forward, and it is within this Court’s discretion to order discovery from the Vice President.</p>
<p><strong>WHEREFORE</strong>, Plaintiff respectfully requests that the deposition of the Vice President proceed.</p>

howard lawyers&#8217; much earlier motion</a>, that if plain-<br />
tiff howard could not obtain the evidence he<br />
was seeking elsewhere, he could always renew his<br />
motion to depose the dick, when all other avenues<br />
had been exhausted. mr. howard&#8217;s lawyers now<br />
effectively swear, as of august 12, 2008, that<br />
moment has arrived &#8212; it is upon us:</p>

Indeed, there is substantial case law in which courts have acknowledged that the deposition of a high-ranking government official is warranted <strong>where the government official has personal knowledge of the matter and the information cannot be contained elsewhere</strong>. D.C. 1998) (“high ranking government officials are generally not subject to depositions unless they have some personal knowledge about the matter and the party seeking the deposition makes a showing that the information cannot be obtained elsewhere”); Church of Scientology v. IRS, 138 F.R.D. 9, 11 (D.Mass 1990) (“[a]n exception to th[e] general rule exists <strong>concerning top officials who have direct personal factual information pertaining to material issues in an action</strong>”); Community Federal Sav. &amp; Loan Assoc. v. Federal Home Loan Bank Bd., 96 F.R.D. 619 (D. D.C. 1983) (holding that the deposition of an agency official may be permitted when the official has relevant first-hand knowledge of matters material to the decision and not available from some other source); Warzon v. Drew, 155 F.R.D. 183, 185 (E.D. Wis. 1994) (“[a]n exception to th[e] general rule exists concerning top officials who have direct personal factual information pertaining to material issues in an action . . . [and] <strong>where the information to be gained . . is not available through any other source</strong>.”); see also, Halperin v. Kissinger, 606 F.2d 1192, 1211 (D.C.Cir.1979) (“Presidents are scarcely immune from judicial process”). </p>
<p>Clearly, <strong>as the victim </strong>of Plaintiff’s <strong>alleged “assault,” the Vice President has personal knowledge of the claims at issue in this litigation. Mr. Howards approached and spoke directly to the Vice President, and it was this act that led to Mr. Howards’ arrest</strong>. . .</i></font></p></blockquote>

<p>just <em>suck on that a while</em>, dick.</p>
<p>let&#8217;s read from <a href="http://judiciary.house.gov/News/PDFs/BatesOpinion080731.pdf">judge bates&#8217; opinion</a> [a pdf file], then:</p>
<blockquote><p><font color="#040080"><i>. . .After all, from Marbury v. Madison, 5 U.S. (1 Cranch) 137, 177 (1803) (“[i]t is emphatically the province and duty of the judicial department to say what the law is”), through United States v. Nixon, 418 U.S. 683, 705 (1974) (the judiciary is the ultimate arbiter of claims of executive privilege), to Boumediene v. Bush, 553 U.S. &#8212;, 128 S. Ct. 2229, 2259 (2008) (rejecting regime in which the political branches may “switch the Constitution on or off at will” and, rather than the judiciary, “say ‘what the law is’”), the Supreme Court has confirmed the fundamental role of the federal courts to resolve the most sensitive issues of separation of powers. In the thirty-four years since United States v. Nixon was decided, the courts have routinely considered questions of executive privilege or immunity, and those issues are now “of a type that are traditionally justiciable” in federal courts, United States v. Nixon, 418 U.S. at 697 (citation omitted), <strong>and certainly not unprecedented, as the Executive contends</strong>.</p>
<p><strong>Indeed, the aspect </strong>of this lawsuit that <strong>is unprecedented </strong>is the notion that Ms. Miers is <strong>absolutely immune from compelled congressional process</strong>. The Supreme Court has reserved absolute immunity for very narrow circumstances, involving the President’s personal exposure to suits for money damages based on his official conduct or concerning matters of national security or foreign affairs. <strong>The Executive’s current claim of absolute immunity from compelled congressional process for senior presidential aides is without any support in the case law.</strong> The fallacy of that claim was presaged in United States v. Nixon itself (id. at 706):</p>
<blockquote><p><strong>neither</strong> the doctrine of <strong>separation of powers</strong>, nor the need for <strong>confidentiality of high level communications</strong>, without more, can sustain an absolute, unqualified Presidential privilege of immunity from judicial [<strong>or congressional</strong>] process under all circumstances.</p></blockquote>
<p>. . .While <strong>the Constitution diffuses power the better to secure liberty</strong>, it also contemplates that practice will integrate the dispersed powers into a workable government. It enjoins upon its branches separateness but interdependence, autonomy but reciprocity. Presidential powers are not fixed but fluctuate, <strong>depending upon their disjunction or conjunction with those of Congress</strong>. . .</font> </p>

well the moment these somber, majestic<br />
thoughts first soaked into your consciousness:</p>
<blockquote><p><span style="color:#040080;"><i>. . .In effect, Attorney General Mukasey created a double standard. Ten years ago, his predecessor, Attorney General Janet Reno, provided the Committee the FBI interviews of both President Clinton and Vice President Gore. <strong>Mr. Mukasey decided that a different rule should apply to Republican presidents than to Democratic presidents</strong>.</p>
<p>Today President Bush has taken the <strong>extraordinary step </strong>of asserting <strong>executive privilege </strong>over the <strong>Vice President&#8217;s interview with criminal investigators</strong>.</p>
<p>The claim of executive privilege <strong>is ludicrous</strong>.</p>
<p>We <strong>are not</strong> seeking access to the communications <strong>between the Vice President and the President</strong>. We <strong>are</strong> seeking access to the communications <strong>between the Vice President and FBI investigators</strong>. <a href="http://indictdickcheney.blogspot.com/2008/06/chairman-waxman-is-closing-cheneys.html">The Vice President talked with the FBI investigators voluntarily and <strong>he did so knowing </strong>that what he said could be <strong>disclosed publicly in a criminal trial</strong>. Mr. Fitzgerald told us that &#8220;there were no agreements, conditions and understandings&#8221; that limited Mr. Fitzgerald&#8217;s use of the interview in any way</a>.</p>
<p>This unfounded assertion of executive privilege <strong>does not protect a principle; it protects a person</strong>.</p>
<p>The President is wrong to shield Vice President Cheney from scrutiny. In our system of government, <strong>even the Vice President should be accountable for his actions</strong>. . .</p>
<p>The President&#8217;s action raises an obvious question: Why is the President preventing responsible congressional oversight of the Vice President? If the Vice President did nothing wrong, <strong>what is there to hide</strong>?</p>
<p>A letter that the Committee received this morning from the Attorney General to the President also raises questions about the President&#8217;s involvement. According to the Attorney General, the documents being withheld summarize conversations held directly with the President. The subjects discussed in the withheld documents include the preparation of the 2003 State of the Union address, the accuracy of the claim that Iraq was trying to obtain uranium from Niger, and the decision to send Ambassador Joe Wilson to Niger.</p>
<p>The <strong>White House misled the nation </strong>about Iraq&#8217;s weapons of mass destruction. On the <strong>eve of the war</strong>, the Vice President said: &#8220;<strong>we believe he has, in fact, reconstituted nuclear weapons</strong>.&#8221;</p>
<p><strong>White House officials then misled the nation about their involvement in leaking Ms. Wilson&#8217;s name</strong>. One top official, Mr. Libby, was convicted of perjury. Yet now that the Committee is trying to find out what really happened, the President has blocked the Committee&#8217;s inquiry by ass~rting executive privilege over key documents. . .</i></p>

<p>mukasey&#8217;s letter attempting to defend this<br />
preposterous assertion of privilege &#8212; at<br />
least to the extent that it asserts a<br />
privilege applies to f.b.i. interviews<br />
with the vice president, and the trans-<br />
cripts capturing the same &#8212; is simply silly:</p>
<blockquote><p><span style="color:darkred;"><i>. . .Were future Presidents, Vice Presidents and senior White House staff to perceive that providing voluntary interviews in the course of Justice Department investigations would create records that would likely be made available to Congress (and then <strong>possibly</strong> disclosed publicly outside of judicial proceedings such as a trial), there would be an <strong>unacceptable risk</strong> that such knowledge <strong>could</strong> adversely impact their willingness to cooperate fully and candidly in voluntary interviews. They might insist, alternatively, on disclosing information only pursuant to grand jury subpoenas in order to ensure the secrecy protections of Rule 6(e) of the Federal Rules of Criminal Procedure. Such a result would significantly impair the Department&#8217;s ability to conduct future law enforcement investigations. . .</p>

<p>how so, mr. attorney general? i mean,<br />
seriously &#8212; this does not remotely<br />
pass the <em><strong>straight face test</strong></em>. so, if<br />
future vice presidents are too cow-<br />
ardly to speak with the f.b.i. about<br />
alleged wrong-doing, and choose to<br />
do so only once rule 6(e) grand jury<br />
secrecy has attached. . . <strong>SO WHAT</strong>?</p>
<p>who <em>cares</em>? all that means is congress<br />
will have to wait until the matter is<br />
resolved by trial or otherwise, by closure<br />
of the grand jury process, without an indictment,<br />
before it will be able to conduct oversight.</p>
<p>that is all it means. any future president,<br />
or vice president will hereafter (due to the<br />
mis-steps of bush &amp; cheney, and nixon &amp; agnew,<br />
before them) know exactly how to make these<br />
interview transcripts secret. agree to talk<br />
only before the grand jury, pursuant to a<br />
confidential summons from the grand jury.</p>
<p>then &#8212; at least until the matter is re-<br />
solved, the interview will remain secret.</p>
<p>so &#8212; mukasey&#8217;s letter simply lets us<br />
know what we already knew &#8212; the president,<br />
and vice president, <strong>both screwed up </strong>their<br />
process on secrecy, <em>just as they did with<br />
war intel, itself</em>.</p>
<p><strong><em>the echoing irony &#8212; is almost deafening. . .</em></strong></p>
